Terms and Conditions

1. Introduction and scope of application

 

These are the terms and conditions (“Terms and Conditions”) of Resonance Waves (“Resonance Waves”, “we”, “us”, “our”), registered at the KvK under number 94914168. 

 

These Terms and Conditions apply to any student (a “Student” or “you”) who attends a class, event, workshop, private and/or corporate session with us and/or visits our website www.resonance-waves.com and/or purchases a class card or other product or service from us. By doing so, you agree to the application of these Terms and Conditions. 

 

2. Opening hours and locations 

 

The opening hours of Resonance Waves depend on the schedule and on whether or not classes, events, workshops and/or sessions may be cancelled. For group classes, please note that access to the location and the class room will be from 15 minutes before the scheduled time of class and up until 15 minutes after it finishes. 

 

Group classes, and private duo or group sessions offered by Resonance Waves take place at Borgerstraat 102, 1053 PW Amsterdam, the Netherlands. 

 

Private 1:1 sessions offered by Resonance Waves take place at Willem de Zwijgerlaan 69, 1056 JG Amsterdam, the Netherlands, unless agreed otherwise. 

 

Corporate sessions offered by Resonance Waves take place on the site/location agreed to with the company/client ordering said session. 

 

3. Class cards:

 

Resonance Waves offers the following class cards (“Class Cards”): 

 

• Trial 3 classes card: this card can only be purchased once by new Students only, and is valid for 1 month from date of purchase. It can be used for 3 group classes in any category of class, ie both “Sound Classes” (classes including the use of music instruments such as nidra & sound, or sound healing classes) and/or “Yoga Classes” (classes that do not include the use of musical instruments, such as yin yoga or breathe & nidra)

• Single Sound Class card: this card can be used once for any Sound Class, within 1 month from the date of purchase. 

• Single Yoga Class card: this card can be used once for any Yoga Class, within 1 month from the date of purchase. 

• 5 Sound Classes card: this card can be used for up to 5 Sound Classes, within 3 months from the date of the first booking. 

• 5 Yoga Classes card: this card can be used for up to 5 Yoga Classes, within 3 months from the date of the first booking.

 

We are entitled to add different class cards to our offering and/or memberships or change the current offering at any time, as we see fit. 

 

All Class Cards can be purchased online on our website  www.resonance-waves.com (“Website”) through our booking partner Eversports. For the avoidance of doubt, all Class Cards listed above are not valid for events, workshops and private and/or corporate sessions, for which special prices apply, unless indicated otherwise on our Website. Private and/or corporate sessions must be booked and paid for separately directly with us, via email (camille.burkhart@gmail.com).

 

The applicable prices for Class Cards, and when applicable events or workshops are listed on our Website, the applicable prices for private sessions are also listed on our Website,  and the prices available for corporate sessions are available on request. Said prices are subject to change at any time as we see fit.

4. Schedule

 

Our group classes schedule, and when applicable the schedule for workshops and/or events, is available on our Website, including any changes thereto. 

 

Although we try to avoid this at all times, we reserve the right to cancel classes, events or workshops scheduled, and/or to substitute teachers announced. In case of substitution, you are not entitled to a restitution or refund, and we will try to inform Students timely, via our Website or by e-mail notification. 

 

For private and/or corporate sessions, please contact us separately in order to schedule said session(s). 

 

5. Booking process, cancellations and no shows

 

a) Booking process: 

 

All group classes, events and workshops can be booked from the moment these are available on our Website and booking system, up until 5 minutes before the start thereof, unless fully booked or otherwise specified. 

 

You can book a group class via our Website or on location, subject to you (i) having a valid Class Card when making such booking and (ii) being registered with us. 

 

You can book an event and/or workshop via our Website or on location, subject to you (i) having paid for the event and/or workshop in full and (ii) being registered with us. 

 

Students who wish to book a class via a third party aggregator (eg. Urban Sports Club) can do so via the platforms of such aggregators, to the extent our group classes are available on said platforms, in accordance with the booking and cancellation policies of these aggregators. 

 

b) Cancellations and no shows:

 

Your booking is valid up until 5 minutes before the group class (or when applicable the workshop and/or event) starts. If you haven’t shown up by then, we consider this a ‘no show’ and we are allowed to give your spot to someone else. Such a ‘no show’ will be registered and, for group classes, deducted from your Class Card (i.e., you will be charged a full class price). In case of no show, you will not be entitled to a restitution or refund. 

 

In case you booked a group class with us, cancellation thereof is only possible up to 24 hours prior to the start time of the class so that somebody else can take your spot, and you will then be entitled to use the corresponding unit from your Class Card for a later group class. A cancellation within 24 hours of the start time of the class will be considered a ‘late cancellation’. Such a ‘late cancellation’ will be registered as a class attended and as such deducted from your Class Card, and you will not be entitled to a restitution or refund

 

The cancellation, late cancellation and no show conditions from third party aggregators such as Urban Sports Club apply to Students who have booked a group class with us via these platforms. 

 

In case you booked an event and/or workshop with us, cancellation thereof is possible up to 7 days prior to the start thereof, unless stated otherwise. In such a case, you are entitled to a full refund (unless stated otherwise). Cancellations within 7 days of an event and/or workshop with us will not be refunded, but you are entitled to transfer your spot to someone else.

 

6. House rules 

 

All Students agree to adhere to the following house rules of Resonance Waves at all times: 

• Participation to all group classes, events, workshops, private and/or corporate sessions is at your own responsibility and risk, at all times. 

• If you have an injury, sickness or other medical conditions, or if you are pregnant, please inform the teacher before the class, event, workshop or session starts. You are responsible for your own well-being, but the teacher is always happy to support you as needed. 

• Make sure to arrive at the correct location, between 5 to 15 minutes before the start of the class, event, workshop, private and/or corporate session. We will not allow Students in once the class, event, workshop or session has started, to make sure other Students enjoy said class, event, workshop or session on time. 

• We value silence. Please switch off your mobile phone or set it on silent mode (no vibration) when entering the location. 

• Leave your shoes and personal belongings where indicated at the location. 

• Please come to class clean, with clean and comfortable clothing, appropriate to the practice of yoga and healing practices, making sure intimate areas are always properly covered. 

• If you have your own favorite eye-pillow, yoga mat, etc. you are always welcome to bring it, although we will have all equipment needed on site. 

• At the end of a class, workshop, event and/or session please place back all props and mats where they belong, after cleaning your yoga mat if appropriate and/or needed and/or as requested by the teacher. 

 

Persons under the age of 18 are not permitted to participate to any group class, workshop, event, private and/or corporate session. 

 

7. Limitation of liability 

 

We don’t accept any liability (in any form whatsoever) for damages to or loss of your property, unless such damage or loss results from our negligence or our default.

 

We don’t accept any liability (in any form whatsoever) for damages in relation to any physical and/or mental injury resulting from your visit to our locations or your participation to our classes, events, workshops, privates and/or corporate sessions, unless arising from our negligence or our default.

 

Nothing in these Terms and Conditions is intended to limit any rights you may have as a consumer under applicable law. 

 

8. Personal data

 

We process your personal data in accordance with our Privacy Notice, which can be found here.

 

9. Governing law and jurisdiction

 

These Terms and Conditions are exclusively governed by Dutch law. Any disputes relating to these Terms and Conditions will be settled by the competent court in Amsterdam.

 

10. Contact details, complaints, company information 

 

In case of any complaint, please turn to the manager of Resonance Waves (Camille Burkhart) and/or the teacher of the class you attended in the first instance. If you feel your complaint was not resolved, please write to camille.burkhart@gmail.com and we will get back to you.
